from six filings Mr. Bartel had made to the local health author- ity where he had relaxed setbacks from sewerage systems to drinking water sources based on his hydrogeological opinion. The Investigation Committee investigated the complaint and recommended a disciplinary inquiry. In lieu of proceeding to a disciplinary inquiry, Mr. Bartel signed a Consent Order admitting that he did not have the required competence in the field of hydrogeology and accepted as his penalty: 1. A reprimand; 2. To cease undertaking any hydrogeological services or providing any hydrogeological advice; 3. To undergo a practice review at his own expense; 4 To have his services relating to wastewater treatment and disposal systems peer reviewed for at least 12 months at his own expense; and 5. Payment of $5,000 towards APEGBC’s legal costs. Consent Dismissal Order – Dr. Rene Georges Abou-Rached, P.Eng., Vancouver, BC
The comments, findings and decisions of a BC Supreme Court Judge and a Supreme Court Registrar regarding Dr. Abou- Rached in the case of International Hi-Tech Industries v. Fanuc Robotics came to the attention of APEGBC and were provided to the Investigation Committee. The Investigation Committee decided to commence an investigation and appointed a sub- committee to review the material and provide a report with its recommendations to the Committee. Information was requested from Dr. Abou-Rached by the subcommittee. Dr. Abou-Rached’s response failed to satisfy the subcommittee and a discipline hear- ing was recommended. A Notice of Inquiry was served on Dr. Abou-Rached for failing to provide the Investigation Committee with information and records in his possession or control con- trary to section 30(4) of the Engineers and Geoscientists Act . In lieu of proceeding to a discipline inquiry, Dr. Abou- Rached and APEGBC signed a Consent Dismissal Order dismissing the charges in the Notice of Inquiry by consent without costs to either APEGBC or Dr. Abou-Rached.
