Disciplinary Hearing - Lorrence Melnechenko, Nanaimo, BC A complaint was received by the Association of Professional Engineers and Geoscientists of BC (APEGBC) relating to Mr. Melnechenko’s engineering services. Pursuant to Section 30(4) of the Act , the Investigation Committee requested Mr. Melnechenko’s complete file for the project in question. Mr. Melnechenko failed to respond to four separate communications from APEGBC staff informing him of the request of the Investigation Committee. The Investigation Committee recommended a disciplinary inquiry be held into Mr. Melnechenko’s failure to respond as required. Mr. Melnechenko resigned his membership with APEGBC by letter dated November 18, 2013. A hearing was held on February 6, 2014. Mr. Melnechenko did not attend. The Discipline Committee issued a Determination and an Order on Penalty and Costs each dated February 18, 2014. The Discipline Committee concluded that Mr. Melnechenko breached Section 30(4) of the Act and demonstrated unprofes- sional conduct. The Discipline Committee noted that it is a fundamental part of a self-governing profession’s mandate to deal with complaints made to it about the conduct of its members. As a result of Mr. Melnechenko’s lack of cooperation, the APEGBC Investigation Committee’s efforts to resolve a complaint against
him has been unsuccessful. The Discipline Committee was of the opinion that Mr. Melnechenko failed to properly understand all of his responsibilities as a professional engineer and determined that if Mr. Melnechenko’s membership with APEGBC is reinstated, it shall be immediately suspended and remain suspended until completion of the following two requirements: • Mr. Melnechenko must provide a complete response, accept- able to the Investigation Committee, to the Investigation Committee’s request for information and documents; and • Mr. Melnechenko must write and pass the Professional Practice Examination. The Discipline Committee also ordered that Mr. Melnechenko pay a fine in the amount of $5,000 and costs in the amount of $6,000 within 60 days of the date of the Order.
