strength to resist seismic forces including adequate member strength, connection strength, and a complete and sufficient load path to transfer the required seismic loads to the foundation; and • ensure for each of the projects that an independent review of the design was completed and properly documented prior to construction. As outlined in the Consent Order, during the suspension period, Mr. Kapusniak was required to successfully complete and pass the Engineers and Geoscientists BC As outlined in the Consent Order, Mr. Zeberoff is restricted from practicing in the area of wastewater sewerage systems (Practice Restriction). Should Mr. Zeberoff wish to lift or modify the Practice Restriction, he must successfully complete an educational program as set out in the Order. If Mr. Zeberoff successfully lifts the Practice Restriction, he must undergo a peer review of all engineering work in the area of wastewater sewerage systems for a minimum period of six months. During the suspension period, Mr. Zeberoff was required to complete the Professional Engineering and Geoscience Practice in BC online seminar and the Authentication of Documents webinar. Mr. Zeberoff paid $5,000 toward the legal costs of Engineers and Geoscientists BC.

Mr. Zeberoff demonstrated a lack of understanding of adequate sewerage system design when acting as the authorized person pursuant to the sewage system regulations for the projects. In the Consent Order, Mr. Zeberoff admitted that he demonstrated unprofessional conduct related to the Nelson and Boswell projects and that he acted contrary to the Bylaws of Engineers and Geoscientists BC. Mr. Zeberoff agreed that, among other things, he failed to: • design the Nelson project in a manner consistent with the

In a November 23, 2023, Consent Order, Kenneth Kapusniak, P.Eng., admitted that he demonstrated unprofessional conduct in relation to the engineering services he provided on Vancouver Island. On December 1, 2023, Mr. Kapusniak’s registration with Engineers and Geoscientists BC was suspended for six months. In 2015, Mr. Kapusniak provided engineering services for the design of two precast concrete parking structures in Campbell River, and Courtenay. Mr. Kapusniak signed and sealed design drawings for the projects that did not comply In a November 9, 2023, Consent Order, Anthony Zeberoff, P.Eng., admitted he demonstrated unprofessional conduct in relation to the engineering services he provided for the design and construction of two sewerage systems in Nelson and Boswell, BC. On November 17, 2023, Mr. Zeberoff’s registration with Engineers and Geoscientists BC was suspended for three months. Mr. Zeberoff is restricted from practicing in the area of wastewater sewerage systems. In 2021, Mr. Zeberoff provided engineering services in relation to wastewater sewerage systems for two different projects located in Nelson and Boswell, BC. Mr. Zeberoff authenticated deficient documentation for the projects that were neither prepared by him nor someone under his direct supervision.
