On January 9-12, 2024, and February 9, 2024, a panel of the Discipline Committee conducted a hearing concerning the engineering services Dr. Mahmoud provided for the project. On July 18, 2024, the panel released their decision, finding that Dr. Mahmoud breached section 20(9) of the Engineers and Geoscientists Act by issuing and providing unsealed copies of the reports for the project. of Engineers and Geoscientists BC. Dr. Mahmoud agreed that, with regard to the Greenwood project, he failed to: • conduct a sufficient geotechnical investigation, and particularly, he failed or neglected to conduct any infiltration testing; • provide the necessary information in the design drawings to construct the elements of the stormwater management plan; • use the correct equation for the purpose of calculating rock pit storage volumes; and • provide properly authenticated drawings to his clients. Dr. Mahmoud agreed that, with regard to the Hycroft project, he failed to: • conduct a sufficient geotechnical investigation, and particularly, he failed or neglected to conduct any percolation testing; • provide accurate, correct, and consistent calculations and design drawings; and • adequately supervise and review the work of the non-registrant

On July 18, 2024, a panel of the Discipline Committee found that Dr. Mahmoud Mahmoud, P.Eng., failed to seal two test pit investigation reports and a report on borehole data before providing them to the owners of two properties in Sechelt, BC. In 2019, Dr. Mahmoud was contract ed by the owners of two properties to conduct a geotechnical investigation in support of a development application made to the District of Sechelt. Dr. Mahmoud issued two test pit investigation reports and one report on the summary of available borehole data for the project. The reports contained Dr. Mahmoud’s geotechnical conclusions and In an October 11, 2024, Consent Order, Dr. Mahmoud Mahmoud, P.Eng., admitted that he demonstrated unprofessional conduct in relation to the engineering services he provided for two projects relating to stormwater management plans in the District of West Vancouver, BC. As of November 12, 2024, Dr. Mahmoud’s registration with Engineers and Geoscientists BC is suspended for four months. Dr. Mahmoud was retained to provide engineering services in relation to the management plan for a residence: the Greenwood project. On a separate project, Dr. Mahmoud was retained to provide engineering services for the preparation of stormwater management plan for a residence: the Hycroft project. The designs that Dr. Mahmoud prepared and authenticated for the Greenwood and Hycroft projects were deficient. In the Consent Order, Dr. Mahmoud admitted that he demonstrated unprofessional conduct related to the Greenwood and Hycroft projects and that he acted contrary to the Bylaws design of a rock pit and the preparation of a stormwater

The panel determined that Engineers and Geoscientists BC was unsuccessful in proving two allegations of unprofessional conduct with regards to Dr. Mahmoud’s geotechnical investigation work for the project and determined that Dr. Mahmoud’s conduct was not a marked departure from the standard expected of a professional engineer. On September 6, 2024, the panel issued their decision on penalty and costs. Dr. Mahmoud was reprimanded and ordered to pay $7,500 toward the legal costs of Engineers and Geoscientists BC. who was primarily responsible for preparing the stormwater management plan. Dr. Mahmoud is restricted from practicing in the area of stormwater system design, rock pit design, or the development or implementation of stormwater management plans, except under the direct supervision of a qualified registrant. Should Dr. Mahmoud wish to lift or modify the practice restriction, he must provide proof that he has completed an educational program and apply for reinstatement of full practice rights through the Credentials Committee of Engineers and Geoscientists BC.
